Welcome to the respiteservices.com Web site (the "Respiteservices site"). Your access to and continued use of the Respiteservices site constitutes your acceptance of, and compliance with, the following provisions. If you have not already done so, please read these terms and conditions (the "Terms of Use"). If you do not agree to these Terms of Use, you should immediately leave the Respiteservices site. Also, note that these Terms of Use may change from time to time and it is your responsibility to periodically visit this page to review the then-current Terms of Use. The last revision date for these Terms of Use is set forth below. 

Respiteservices.com Web site is owned by Geneva Centre for Autism ( the host agency for the respiteservices.com site in Toronto).  However, other respiteservices.com local websites are operated by local host agencies in many Ontario communities.  Local host agency(ies) have custody and control over information within their local site.  Local host agency(ies) are responsible for maintaining confidentiality and ensuring that they are in compliance with all applicable privacy laws.  Geneva Centre for Autism has designated  “superuser(s)” that will have access to all local respiteservices.com websites in order to support local host agencies in developing their sites and to provide technical support.  

By submitting your information, your request for service implies consent for respiteservices.com host agencies to collect, use and disclose your personal information for purposes related to responding to your needs.  This includes sharing your information with other respiteservices.com host agencies, provincial superusers, and the single point of access to services (in communities where an agency has been designated to be a single point of access to services) in order to support your request for services.
   
We do not share your personal information with anyone outside of respiteservices.com host agencies, our agents, and the single point of access without your consent, unless necessary for legal reasons. 
Consent may be implied or express. Consent may be provided orally, electronically or in writing.

With your consent, we may share information with third parties including:
 
•    other agencies, professionals, and others who are involved in your care and treatment; 

•    other agencies and professionals who provide services and supports that may be able to respond to your needs; and 

•    other individuals you identify as contacts, such as family members

We may disclose information without your consent:
 
•    for legally necessary disclosures ordered by a subpoena or required to notify authorities in situations of suspected abuse, neglect, or imminent harm. 

•    if required by The Ministry of Community and Social Services  or the Ministry of Community and Social Services 

Should you register for the workerbank program, you are agreeing to keep any worker profile information you receive confidential, unless you receive consent by the worker to share the information.  You acknowledge that the worker screening processes vary across the province and when registering to a specific respiteservices.com community, you are agreeing to receive worker profiles that have been screened according to that community’s screening process.

In cases where you would like to be connected to respite programs or options, there will be a need to disclose the information to other respite agencies/service providers.  Your request implies consent to forward your information to these agencies.

By submitting your request for service, you have acknowledged that you have read and agree to the website privacy policy.  

Limited Right to Use

The Respiteservices site is owned and operated by Geneva Centre for Autism.  Respiteservices.com is built on a portal system that creates one central database.  However, local communities can use the web site and database to create their sub-sites , communities have access only to their local community information and  maintain their own site and database even though within the site is hosted by specific agencies within that community.  Data collected remains within each community-based host agency.

All materials on the Respiteservices site, including, without limitation, all text, HTML code, multimedia clips, images, graphics, icons, code, software and the selection and arrangement of the contents of the respiteservices.com site (the "Materials") are the property of respiteservices.com or are licensed or used with permission by respiteservices.com  and are protected by the copyright laws of Canada and other applicable Canadian and international copyright and intellectual property laws, unless otherwise noted. You may only use the Materials on the respiteservices.com site as permitted in these Terms of Use. 

You may use, view, print and/or download one copy of short extracts of the materials on any single computer solely for your personal, informational, non-commercial use within your organization only, provided you keep intact all copyright and other proprietary notices contained on the Materials. You shall be fully responsible for any consequences resulting from such use. Any other use of the Materials is prohibited. You may not copy, distribute, modify, transmit, reuse, report, reproduce, disseminate, upload or post the Materials, in whole or in part, by any means, without prior written permission of [respiteservices.com]. The use of any Materials on any Respiteservices site for networked computer environment or for any other purpose is strictly prohibited and such unauthorized use may violate copyright, trademark, privacy, communications and other similar laws.

These links are being provided to you as a convenience and should not be construed as an endorsement of the related site, its owner, products or services. If you decide to access any of the third party sites linked to this Respiteservices site, you do so entirely at your own risk. [Respiteservices.com] reserves the right to terminate any link at any time. A link to another site should not be construed to mean that [respiteservices.com]  is affiliated or associated with, or is legally authorized to use any trademark, trade name, logo or copyrighted symbol that may be reflected in the link or in the description of the link to such other sites. [Respiteservices.com] disclaims any and all warranties, express or implied, to any such linked sites, including but not limited to any terms as to the accuracy, ownership, validity or legality of any content of a linked site.

Communications

Unless otherwise explicitly stated herein, any communication or material that you transmit to the Respiteservices site by electronic mail or otherwise, including any data, software, questions, comments, suggestions or the like, is and will be treated as, non-confidential and non-proprietary. All non-personal information submitted to respiteservices.com  including, without limitation, comments, information, feedback and ideas regarding our company, products or services ("Non-Personal Information") shall be deemed at the time of the communication to be, and shall remain, the property of [respiteservices.com].  [Respiteservices.com] shall be entitled to full unrestricted rights of ownership in relation to the Non-Personal Information including, without limitation, the right to use or disclose such Non-Personal Information in any form, medium or technology now known or later developed, and for any purpose, commercial or otherwise as it sees fit in respiteservices.com 's sole discretion without compensation to you. 

Absent the use of encryption, the Internet is not a secure medium and privacy cannot be ensured. Internet e-mail is vulnerable to interception and forging. Respiteservices.com  will not be responsible for any damages you or a third party may suffer as a result of the transmission of information that you make to respiteservices.com  through the Internet, or that you expressly or implicitly authorize [respiteservices.com] to make, or for any errors or any changes made to any transmitted information.

You are solely responsible for the content of your communications and their legality under all laws and regulations. You agree that any information submitted for inclusion on the Respiteservices site does not infringe the intellectual property rights or other rights of any third parties and you grant [respiteservices.com] a right to provide access to such information from the Respiteservices site. 

Password and Security
 
You may receive a username and password upon completing the registration process. You are responsible for maintaining the confidentiality of the username and password, and are fully responsible for all activities that occur under your username and password. You agree to (a) immediately notify respiteservices.com of any unauthorized use of your user name and password or any other breach of security, and (b) ensure that you log out of your account at the end of each session. Respiteservices.com cannot and will not be liable for any loss or damage arising from your failure to comply with maintaining the security of your username and password.   Respiteservices.com grants you a personal, non-transferable and non-exclusive right to use the Services, which include access to your profile and worker profile matches by providing you, a single user, a username and password. You agree not to provide any other individual access to respiteservices.com via your login information.  Respiteservices.com reserves the right to terminate your access at any time without notice.

Termination of Account 

You agree that respiteservices.com, in its sole discretion, may at any time terminate your username and password, account (or any part thereof) or use of the Services, and remove and discard any information related to your account within the Web site, for any reason.  Respiteservices.com may also in its sole discretion and at any time discontinue providing the Service. The limitations and disclaimers of warranties, and the indemnity obligations, and the provisions of governing law, jurisdiction and venue, shall survive any such termination.

Trademarks

Certain words, phrases, names, designs or logos used on the Respiteservices site may constitute trademarks, service marks or trade names of [respiteservices.com] or third parties. The trademarks, logos and service marks (collectively, the "Trademarks") displayed on the Respiteservices site are either Trademarks of [respiteservices.com] or of third parties. Limitation of Liability

While efforts are made to ensure that all information provided on the Respiteservices site does not contain computer viruses, [respiteservices.com] assumes no responsibility and shall not be liable for any damage to or viruses that may infect your computer equipment or other property, or for any corruption or loss of data on account of your access to, use of, or browsing on the Respiteservices site, or your downloading of any Materials from the Respiteservices site. You should take reasonable and appropriate precautions to scan for computer viruses and should ensure that you have a complete and current backup of the applicable items of information contained on your computer system.

Modifications

[Respiteservices.com] may at any time change these Terms of Use by updating this posting without any notice to you. Your use of this Respiteservices site following any such change constitutes your agreement to follow and be bound by the Terms of Use as changed.

Indemnification

You agree to indemnify and hold harmless [respiteservices.com] and its directors, officers, employees, agents and affiliates from and against any claim, liability, damages, losses or expenses (including attorney's fees and costs) arising from or relating to your access and/or use of this Respiteservices site. 

Governing Law and Miscellaneous

All matters relating to your access and/or use of this Respiteservices site shall be governed by the laws of the Province of Ontario and the laws of Canada applicable therein, without giving effect to any principles of conflicts of law. You hereby consent and submit to the exclusive jurisdiction of the courts of the Province of Ontario in any action or proceeding arising from or in any way related to your access and/or use of this Respiteservices site. If any provision of these Terms of Use shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these Terms of Use and shall not affect the validity and enforceability of any remaining provisions.
